1. Introduction

Welcome to Elements Health and Skin LLC ("Company," "we," "us," or "our"). By accessing our website, purchasing products, enrolling in programs, booking services, or using any content we provide, you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use of our website and services.

2. Eligibility

You must be at least 18 years of age to purchase products, enroll in programs, or book services. By using our website or purchasing from us, you represent that you are 18 or older and legally able to enter into this agreement.

3. Scope of Services & Products

Elements Health and Skin LLC offers:

Holistic wellness education and coaching
Functional and wellness lab interpretation
Group programs, memberships, and digital courses
Skincare, makeup, supplements, and wellness products
Educational content via website, email, video, and social platforms

All offerings are provided for educational, informational, and general wellness purposes only.

4. No Medical Advice or Diagnosis

Elements Health and Skin LLC does not provide medical advice, diagnosis, or treatment.

Nothing on this website or in our services is intended to replace the advice of a licensed physician or healthcare provider. Always consult your healthcare provider regarding medical conditions, medications, or treatment decisions. We work alongside your healthcare team, never in place of it.

5. Self-Responsibility & Informed Consent

By using our services or purchasing products, you acknowledge and agree that:

You are responsible for your own health decisions
Participation is voluntary
Results vary by individual
You assume full responsibility for any actions taken

6. Client & Customer Responsibilities

You agree to:

Consult a healthcare provider when appropriate
Discontinue use of any product if adverse reactions occur

We are not responsible for misuse of products or failure to follow instructions.

7. Retail Products (Supplements, Skincare & Makeup)

a. Product Use
All products sold are intended for personal use only and should be used as directed. Supplements are not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the Food and Drug Administration.

b. Allergies & Sensitivities
You are responsible for reviewing ingredient lists. Elements Health and Skin LLC is not liable for allergic reactions or sensitivities.

c. Results Disclaimer
Individual results vary. No guarantees are made regarding outcomes from product use.

8. Orders, Shipping & Delivery

Orders are processed in a timely manner but shipping times are not guaranteed
We are not responsible for carrier delays
Shipping fees are non-refundable

9. Returns & Refunds (Retail Products)

Due to hygiene, safety, and regulatory reasons:

All supplement, skincare, and makeup sales are final
No returns or refunds on opened, used, or tampered products

Damaged or incorrect items must be reported to info@elementshealthandskin.com within 7 days of delivery, with photos of the item and packaging. Verified damaged or incorrect items will be replaced at no cost, or refunded if a replacement is unavailable. This is the sole remedy for damaged or incorrect orders.

10. Services, Programs & Digital Products

a. Payment
Payment is due at the time of purchase unless otherwise stated. Payment plans must be completed in full. If a scheduled payment fails or is not received within 7 days of its due date, access to the program, materials, calls, and support may be paused until the account is current. You remain responsible for the full balance regardless of participation, and unpaid balances may be referred for collection.

b. Cancellations

Results Review calls: one free reschedule is included with at least 24 hours' notice. A no-show, a same-day cancellation, or arriving more than 10 minutes late requires a $100 rebooking fee before a new appointment can be scheduled. Full terms are provided in your service agreement.
For all other appointment types, no-shows or late cancellations may be charged up to 100% of the service fee.

c. Refund Policy

All sales are final. All services, digital products, programs, memberships, and lab services are non-refundable, including before a program begins, before materials are accessed, and before a lab is ordered. Payment plans do not change this: you remain responsible for the full balance.

This policy is disclosed before purchase. You confirm you have read and agree to it at checkout, and no purchase can be completed without doing so.

Nothing in this section limits any right you have under applicable law that cannot be waived by agreement. If we choose to issue a credit or accommodation in an individual situation, that is a one-time courtesy at our sole discretion and does not change this policy or create any obligation to do the same again.

11. Memberships & Recurring Billing

a. Automatic Renewal
Memberships are billed on a recurring monthly basis and renew automatically each month until cancelled. By enrolling, you authorize Elements Health and Skin LLC to charge your payment method the then-current membership rate each billing cycle, without further notice, until you cancel.

b. How to Cancel

You may also cancel by emailing info@elementshealthandskin.com.

Your cancellation is effective when you submit the form or send the email, and we will confirm it in writing within one business day. To avoid being charged for the next cycle, your cancellation request must be received at least seven (7) days before your next scheduled billing date. Cancellation requests received less than seven days before a scheduled draft will take effect after that payment.

c. Effect of Cancellation
Cancellation stops future billing. It does not refund charges already processed. You retain access for the remainder of the billing period you have already paid for. Partial months are not refunded or prorated.

d. Access
Membership access includes only the benefits described for your tier at the time of enrollment. When a membership ends or is cancelled, access to member spaces, group calls, member content, and member communication with Elements Health and Skin LLC ends on the last day of the paid period.

e. Rate Changes
We may change membership rates. If we do, we will provide written notice to the email address on your account at least 30 days before the change takes effect, and you may cancel before the new rate applies.

f. Failed Payments
If a recurring payment fails, we may retry the charge. If payment is not successfully collected, membership access may be suspended or terminated.

12. Labs & Third-Party Services

Lab services may be fulfilled by third-party providers. Elements Health and Skin LLC is not responsible for delays, errors, or outcomes related to third-party labs. Lab results are reviewed for educational and wellness purposes only and do not constitute a diagnosis. We encourage you to share your results with your healthcare provider.

13. Privacy & Confidentiality

We respect your privacy. Personal information is used only to:

Deliver services and products
Process payments
Communicate with you
Comply with legal obligations

We do not sell or rent your personal data. Our full Privacy Policy, which governs how we collect, use, and store your information, is available at elementshealthandskin.com/privacy-policy and is incorporated into these Terms by reference.

14. Limitation of Liability

To the fullest extent permitted by law, Elements Health and Skin LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of our services, products, or content. To the fullest extent permitted by law, our total liability for any claim shall not exceed the amount you paid to us for the specific product or service giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Indemnification

You agree to indemnify and hold harmless Elements Health and Skin LLC, its owners, employees, and contractors from any claims, damages, losses, or expenses, including reasonable attorney fees, arising out of your misuse of our products or services, your violation of these Terms, or your violation of any law or the rights of a third party.

16. Intellectual Property

All content, branding, programs, images, and materials are the property of Elements Health and Skin LLC and may not be reproduced without written permission.

17. Changes to Terms

We reserve the right to update these Terms at any time. The "Last updated" date above reflects the most recent revision. Continued use constitutes acceptance of changes.

18. Governing Law

These Terms are governed by the laws of the State of Alabama, with jurisdiction in Tuscaloosa County, Alabama.
